Welcome to Cyxth (the "Site"). By accessing or using the Site, you agree to be bound by these terms of service (the "TOS") and our privacy policy (the "Privacy Policy"). If you do not agree to the TOS and Privacy Policy, do not use this site or any of our services.

Cyxth is a software as a service (SaaS) platform that allows developers to access and use our Realtime Communication APIs to provide services to their respective end users. We may also store some end user data you provide to us in connection with these services.

Our Services are intended for use by individual developers and organizations. By using the Services, you represent and warrant that you have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to the terms of service. in which case the words “you” and “your” as used in these Terms shall refer to such entity.

Privacy

We respect your privacy and are committed to protecting it. Our Privacy Policy, which is incorporated into the TOS by reference, explains how we collect, use, and share your personal data when you use the Services. By using the Services, you consent to the collection, use, and sharing of your personal data as described in our Privacy Policy.

Accounts and Registration

In order to use the Services, you must create an account and provide certain personal information, such as your name, email address, and password. You may also be asked to provide a profile photo and details about your organization. It is your responsibility to keep your account and password confidential and to prevent unauthorized access to your account. You are also responsible for any activities that occur under your account

If you suspect any unauthorized use of your account or any other security breach, you must immediately notify us. We are not responsible for any loss or damage resulting from your failure to maintain the confidentiality of your account.

We reserve the right to terminate or suspend your account at any time, if you fail to adhere to our terms of service.

Fees and Payments

Our Services are offered on a subscription basis and are billed on a monthly basis. The current fees for the Services are set in our pricing section. By using the Services, you agree to pay all applicable fees.

If you fail to make timely payment, you will be notified and given a grace period of one week to make payment. If payment is not received within the grace period, your account may be suspended until payment is received.

We reserve the right to change the fees for the Services at any time, with or without notice. If we change the fees for the Services, we will provide notice through our website or by other means, such as email. If you do not agree to the new fees, you may terminate your account by following the instructions in the Termination section of the TOS

If you believe that you have been charged incorrectly, or if you have any questions about the fees for the Services, please contact us at help@cyxth.com. We will investigate any disputed charges and will work with you to resolve the issue.

If you believe that the fees set forth in the Pricing section of our website are incorrect, please contact us at help@cyxth.com to report the error. We will investigate and, if necessary, make any adjustments to the fees.

Force Majeure

Neither party shall be liable for any failure or delay in the performance of its obligations under the TOS due to causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, strikes, or government action.

If a party is unable to perform its obligations due to a force majeure event, it shall promptly notify the other party and use reasonable efforts to minimize the impact of the event. The affected party's performance shall be excused for the duration of the event.

If the force majeure event continues for longer periods of time, either party may terminate the TOS upon written notice.

Modification of TOS

We reserve the right, at our sole discretion, to modify or replace the TOS at any time. If we make material changes to the TOS, we will provide notice through our website or by other means, such as email. We encourage you to review the TOS whenever you access the Site to stay informed of any changes.
